Cloud Privacy Policy

Effective as of September 1, 2013.

This Privacy Policy is incorporated in and forms an integral part of Link’s Cloud Services Terms of Service (“TOS”).  All capitalized terms used in this Privacy Policy shall have the meaning set forth in the TOS unless otherwise expressly provided.



LinkBermuda Ltd. (collectively with its affiliates, “LinkBermuda” “We”, “Our” or “Us”) respects the privacy of Our customers (collectively, “You”, “Your”, or “Customer”), and values the confidence of its Customers, employees, consumers, business partners and others.  We strive to collect, use and disclose personal information in a manner consistent with the laws Bermuda and other countries in which We do business.  We pride ourselves on upholding the highest ethical standards in Our business practices.

Our Privacy Policy has been created to explain the way in which We use Your personal data and sets forth the privacy principles and procedures that We follow.

We may, in Our sole discretion, modify or change Our Privacy Policy at any time (for any reason or no reason), effective immediately upon posting such modifications or changes (or a revised version of this Privacy Policy incorporating such modifications or changes therein) on or through Our website.  Please periodically consult this Privacy Policy to determine when it was last revised.  You agree to periodically review this Privacy Policy to ensure that You are in compliance with any ongoing changes or modifications that are made to the Privacy Policy.  Your continued use of Our website and Services after any such modifications or changes are posted will constitute Your complete and unequivocal acceptance of such any modifications or changes to Our Privacy Policy.  Our Privacy Policy explains the following regarding LinkBermuda’s treatment of personal data:

✓  The practices and procedures LinkBermuda follows to collect Your personal data

LinkBermuda will use Your personal data where it is necessary to do so because it is relevant to LinkBermuda’s dealings with You (i.e., it is relevant to the provision of the goods and/or services that You have requested from LinkBermuda) including for billing, customer service and network management.

LinkBermuda will only use Your personal data in a way that is fair and lawful; taking into account Your consent, the extent to which it Is necessary for Us to use Your personal data in its dealings with You and the purposes which are disclosed to You in this Privacy Policy or which are relevant to the reason for Your giving Your personal data to Us.  LinkBermuda will not sell, trade or rent Your personal information to others. 

We may provide Your personal data to third-party service providers who work on behalf of or with Us to provide some of the Services and features of the sites or Services and to help Us communicate with You.  Examples of the types of third party service providers We may use include a billing service provider to send bills via email out on Our behalf or a credit card processing company to process payments.


Backed-up Data

If You are a Subscriber to Our BaaS Cloud Service, We only share Backed-up Data as follows:

·       If You are a Business Subscriber User, to Your employer;

·       To third-party service providers who work on behalf of or with Us to provide some of the services and features of Our website or BaaS Cloud Services; or

·       If We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) comply with any applicable law, regulation, legal process or enforceable governmental request, (b) enforce Our TOS, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of LinkBermuda, its customers or the public as required or permitted by law.


·       Information that We capture from all visitors to Our website:

IP address, HTTP referrer information and requested pages logged into plain text and databases.


·       Information that We capture from Customers that sign up for Our Cloud services:

IP address, HTTP referrer information and requested pages are logged into plain text and databases, in addition to Your “username”, email address, URL, billing and mailing addresses, and credit card (number, expiration data and CCV) or billing information.


·       Information that We capture from Customers that log into Our servers via SSH and SFTP:

IP address, reverse DNS information and initial commands are logged into secured local and remote text files and databases.


·       Information that We capture from Customers that execute programs or script on Our servers:

User, script name and binaries used logged into secured local and remote text files and databases are logged.


·       Customers that submit issues to Us via electronic media:

IP address, username, URLs and email addresses are captured.


·       Backed Up Data:

The contents of Backed-up Data can include both personal information and anonymous information such as email addresses, home addresses, telephone numbers and other content communicated over email or inside contact fields, but We treat Backed-up Data differently regardless of its contents.  We collect Backed-up Data that You have requested for Us to collect from authorized third-party systems.  If You are a Business Subscriber User, then your employer may have designated the Backed-up Sites or authorized Our services on Your behalf.  We will associate Your Backed-up Data with Your personal information.

We will access and use Your Backed-up Data only when You (or, if You are a Business Subscriber User, Your employer, to the extent permitted by such employer’s policies) grants Us explicit permission to do so for troubleshooting purposes.  We will not otherwise view, access or use the contents of Your Backed-up Data without Your written consent, but may view the related file system information (e.g., file and/or folder names, file extensions and sizes but not Your file contents) to provide incremental backups and file comparisons, quality control, and technical support.


✓  Use of “cookies”

LinkBermuda may use “cookies” on Our website(s).  A “cookie” is a small piece of information that a website sends to Your hard drive while you are viewing the website so that it can remember pieces of information about You when You next visit the website or a related website.  Standing alone, Cookies do not personally identify you but merely recognize Your web browser.  LinkBermuda uses cookies to record personal data about You when You use Our website in order to facilitate Your future activities.  Unless otherwise notified by LinkBermuda, We will not use personal data sent in a cookie for marketing purposes and We will not share this personal data with third parties.  If You prefer not to receive cookies from LinkBermuda’s website, You can set Your browser to warn You before accepting cookies and refuse the cookie when Your browser alerts You to its presence.  You can also refuse cookies by turning them off in Your browser but this may impair Your experience of LinkBermuda’s website.


✓  Security of Your personal data

LinkBermuda has in place appropriate technical and organisational security measures to prevent:  unauthorized or unlawful disclosure or access to; accidental or unlawful loss of or destruction or alteration or other damage to Your personal data.  These measures ensure an appropriate level of security in relation to the risks inherent in the processing and nature of the personal data to be protected.  Your securely held personal data will only be accessible by authorized members of Our staff.


✓  Your rights to Your personal data held by LinkBermuda

LinkBermuda will only keep Your information for as long as we are either required to by law, or as is relevant for the purposes for which it was collected.

During this period, You may contact LinkBermuda at any time if You would like to see details of the personal data that We hold about You, details (available to LinkBermuda) as to the source of that personal data, the purposes for which Your personal data are being used, details of the parties with whom We may share Your personal data or to ask Us to correct, update, supplement or delete Your personal data.
